EB-3 Visas for skilled workers, professionals, and unskilled workers

Unskilled Workers

For individuals who are performing unskilled labor that requires less than two years of training.

Professionals

    For individuals with a U.S. or foreign equivalent baccalaureate degree who are members of the professions.

Steps

Obtain a prevailing wage and conduct recruitment for U.S. workers.

If not enough qualified U.S. workers apply, submit PERM application to the Department of Labor.

Once PERM is certified by the Department of Labor, submit petition to USCIS for immigrant worker.

Once a visa is available, worker can apply for a green card (if in the United States) or apply for an immigrant visa (if outside the united States).

Overview of the Process

While this process will lead to permanent residency for the worker, it does take longer than other employment based options due to all the steps that must be completed.

First, the employer must obtain a prevailing wage and conduct recruitment for U.S. workers who are willing and able to do the position. If not enough people are qualified for the position, the employer moves to the next step in the process to submit a PERM application for labor certification to the Department of Labor for the worker.

Once the PERM is approved, the employer will submit a petition for an immigrant worker to USCIS. Then, when a visa is available and the petition has been approved, the worker can apply for the immigrant visa or for the green card, depending on if they are in the United States or abroad.

The worker will be able to bring their spouse and unmarried children under 21 on this process and they will also be eligible for the green card.
